Terms
Last updated 19 October 2026
These Terms are the agreement between you and Moments. By making an account or using Moments, you agree to them. If you do not agree, do not use Moments.
If you live in the United States, section 14 has you and us settle disputes one at a time, by binding arbitration and not in court, with no class actions and no jury trial. You can opt out within 30 days of first agreeing to it. Section 14 says how.
Some sections apply only in some places, and say so. Section 14 applies only if you live in the United States. Section 15 applies only if you live in the European Union or the European Economic Area, and where it differs from another section, section 15 is the one that applies to you.
1. The agreement, and who it is with
Moments is provided by Vitae AI LLC. In these Terms, “Moments”, “we” and “us” mean Vitae AI LLC. Our name and address are shown with the support address at the end of this page on our website. In the app, the support address is under Settings.
To reach us about anything in these Terms, write to that support address. A person reads it.
2. What Moments is, and what it costs
Moments is an iPhone app for keeping up with a few close friends. You and a friend get the same Prompt, you each record a Response, and you see theirs once you have made yours. You can create an account when account creation is available in the app. An Invite link helps you find the person who sent it or join a Circle; it is not always required to create an account.
It costs nothing. There is no fee, no subscription and nothing to buy inside the app. We do not sell advertising and there is no ad code in the app. If that ever changes, we will say so here and in the app before it does.
3. Who can use Moments
You must be 18 or older to use Moments.
The app asks your date of birth before an account exists. Where the app receives an age range for you from Apple, it uses that as well, and a range under 18 is refused. Your date of birth is your own statement, and by using Moments you confirm that it is true.
If you are under the age at which you can make a contract where you live, a parent or guardian must have read these Terms and agreed to them with you.
If we learn that an account belongs to someone under 18, we end the account and delete what it holds. While Moments is in testing, this does not apply to an account made before 16 October 2026, when Moments was for people 16 or older: that account stays open. A parent or guardian who believes their child under 18 has an account can write to the support address, and we will act on it.
You may not use Moments if we ended an earlier account of yours for breaking these Terms, if you are a convicted sex offender, or if a law that applies to you or to us forbids it.
4. Your account
One account per person. Do not make an account for someone else, and do not pretend to be someone you are not.
Keep your sign-in to yourself. You are responsible for what is done through your account. If you think someone else has got into it, write to the support address straight away.
We can refuse a name or a username, or take one back, if it pretends to be someone else or breaks section 7.
5. What belongs to you
Everything you record and write is yours.
You give us permission to do these things with it, and nothing else:
- store it;
- deliver it to the people you sent it to, and put it in your own data download;
- keep it for the periods the Privacy page states;
- open one Response or Reply when it is reported or named in a copyright notice, as sections 8 and 9 describe;
- hand it over when a law or a court order that binds us requires it;
- delete it.
In legal words: this is a non-exclusive, royalty-free, worldwide licence that lasts for as long as we hold the item. It covers the technical copies that storing and delivering need, including backups, on the servers we run Moments on. It covers nothing more.
No AI reads your responses.
We do not read your Responses or your Replies either. The one exception: if someone reports a Response, one person on our team looks at that Response, and only that one, to decide what to do. The same goes for a Reply that is reported.
We do not sell what you send, we do not train anything on it, and we do not license it to anyone. Read Privacy for exactly what we do and do not read.
When you send something, you confirm that you have the right to send it: that it is yours or you have permission, that the people recorded in it agreed to be recorded, and that sending it breaks no law and nobody’s rights.
You can take your data out and delete your account at any time. See Delete your account.
If you send us an idea about how to make Moments better, we can use it without owing you anything.
6. The app, and Apple
The app, its design, its name and the Prompts belong to us. You may use the app for yourself, for keeping up with your friends, and for nothing commercial.
The licence to the app itself is Apple’s standard licence agreement for apps from the App Store, which Apple calls its Standard EULA. These Terms do not replace it. They cover the service behind the app: your account, and everything you send and receive through it.
Apple is not a party to these Terms and is not responsible for Moments. Questions and complaints about Moments come to us, not to Apple.
7. The rules
Moments has no tolerance for objectionable content or abusive users.
We remove what breaks these rules, and we suspend or end the accounts of the people who break them.
You may not use Moments for any of these:
- Sending someone what they have told you they do not want, or pursuing them across Threads and Circles after they removed you.
- Harassing, bullying, shaming or stalking anyone.
- Recording or writing something that threatens someone, or that puts someone in danger.
- Anything that sexualises, exploits or endangers a person under 18. One instance ends the account, and we report it where the law requires.
- A nude or sexual image or recording of anyone who did not agree to it being sent, or sent to anyone who did not ask for it.
- Attacking a person or a set of people for who they are: their race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability or illness.
- Recording someone who did not agree to be recorded, and sending it here.
- Sending someone else’s work, name, face or voice without the right to.
- Anything unlawful where you live or where the person receiving it lives, including fraud and selling what may not be sold.
- Advertising, selling, or sending the same thing to many people who did not ask for it.
- Saving, copying, recording or passing on another person’s Response or Reply, or getting around Once, the Lock, or the way a screenshot comes out blank.
- Using someone else’s account, or getting into the app or our servers in a way we did not build: no scraping, no automated access, no reverse engineering beyond what the law allows, no harmful code, no overloading.
- Making a report you know to be false, or opening a new account after we ended yours.
- Helping someone under 18 to use Moments.
8. Reports, and what we do about them
We do not look through what people send, before or after it is delivered. We act when someone tells us.
The app keeps a short list of words on your phone. When something written to you contains one of them, your phone shows that Response or Reply blurred, and you can tap to see it. The check is made on your phone and sends nothing to us. It reads written words only, not video, audio or photos.
Report is in the menu on every Moment, every Response and every Reply, in Circle Settings and on a Friends row. If you are unable to open the app, write to the support address.
A report opens a case. Reports are reviewed within 24 hours.
Most cases are decided without opening anything, on what we can already see: how many different people reported it, how old the account is, how the people involved are connected, and what earlier cases decided. When a case needs more, one person on our team opens what was reported, and only that. No model reads it, at any stage.
One kind of decision can be made without a person: closing a report that plainly has nothing behind it. Nothing is ever done to a person, a Response or a Reply without a person deciding it.
We can do nothing, remove the Response or Reply, remove the person from a Circle, or suspend the account, for a time or for good. We weigh how serious it was, whether it was repeated, the harm it did, and whether it was meant. The worst breaches end the account the first time.
We do not tell a person that they were reported, or by whom. Section 9 has the one exception. The person who reported is told that the report was reviewed, and nothing about another person.
If we suspend your account, the app tells you. We tell you why in one sentence, and how to appeal.
You can appeal a suspension, or any other decision we made about what you sent, by writing to the support address within 6 months of the decision. A person looks at it again and tells you the result. An appeal costs nothing.
These Terms do not stop us from doing what a law or a court order that binds us requires.
Blocking someone is separate from reporting them. It ends your friendship and hides your individual Thread and profiles from each other, without telling them. It does not hide Responses in Circles you share. You can unblock in Settings, then Privacy, then Blocked people; that does not restore the friendship.
9. Copyright
Send only what you made, or what you have the right to send.
If you believe something sent through Moments infringes your copyright, write to our copyright agent at the support address, with “Copyright” as the subject. For a notice under the US Digital Millennium Copyright Act, include all of this:
- your signature, physical or electronic, or that of the person allowed to act for the owner;
- the work you say was infringed;
- what you say infringes it, and enough for us to find it: the Thread or Circle, who sent it, and when;
- your name, postal address, telephone number and e-mail address;
- a statement that you believe in good faith that the use is not allowed by the owner, the owner’s agent or the law;
- a statement that the notice is accurate and, under penalty of perjury, that you are the owner or are allowed to act for the owner.
We handle a copyright notice the way we handle a report: one person opens the item it identifies, and nothing else. If it infringes, we remove it and tell the person who sent it, because the law gives that person the right to object. It is the one case in which we tell someone that something of theirs was reported.
If something of yours was removed and you believe that was a mistake, you can send a counter-notice to the same address, with: your signature; what was removed and where it was; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your name, postal address and telephone number; and a statement that you accept the jurisdiction of the federal district court for the place where you live, or, if you live outside the United States, of any district where we may be found, and that you will accept service of process from the person who sent the notice. We pass the counter-notice to that person. Unless they tell us within 10 business days that they have gone to court, we put the item back within 10 to 14 business days of receiving the counter-notice.
We end the accounts of people who infringe repeatedly.
Anyone who knowingly sends a false notice or counter-notice can be liable for the damage it causes.
10. Ending
You can stop at any time by deleting your account. Delete your account says what is deleted and what your friends keep.
We can suspend or end your account if you break these Terms, if the law requires it, or if keeping it open would put someone in danger or expose other people or us to harm.
We can change Moments, add or remove parts of it, or stop providing it. If we close Moments, we tell you in the app first, so that you can take your data out.
When your account ends, this agreement ends with it. Sections 9 and 11 to 18 stay in force, and section 5 stays in force for as long as we still hold something you sent.
11. No warranty
We work to keep Moments running. We make no promise that we will succeed.
Moments is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from a course of dealing. We do not promise that Moments will always be available, that it will work without interruption, delay or error, or that it will be free of harm. We do not promise that a Response you sent will still be there after we delete it at 3 years, or after the person who sent it deleted it.
We do not look through what people send, and we do not control what the people you choose as friends say or do, in Moments or anywhere else. You may be sent something offensive, unlawful or untrue. The person who sent it is responsible for it, and we are not.
Moments is not a way to reach the emergency services. If you or someone else is in danger, call them.
12. Limit of our liability
To the fullest extent the law allows, Moments and the people who work on it are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible loss, arising from or related to these Terms or Moments, whatever the legal theory, and even if we were told the loss was possible.
That includes loss arising from what another person sends, says or does, in Moments or anywhere else; from something you sent being captured, kept or passed on by a person you sent it to; from someone else getting into your account; from Moments being unavailable; and from anything being deleted.
Our total liability for every claim arising from or related to these Terms or Moments is limited to 100 US dollars, or to what you paid us in the 12 months before the claim arose if that is more.
These limits apply as far as the law where you live allows, and no further. If you live in New Jersey, sections 11, 12 and 13 are meant to be only as broad as New Jersey law allows. If you live in the EU or the EEA, section 15 replaces this section.
13. If you cause a claim against us
If someone brings a claim against us because of what you sent through Moments, how you used Moments, or your breach of these Terms or of the law, you will, as far as the law allows, cover what that claim costs us: the damages, the losses and the reasonable legal fees. We will tell you about the claim, and we may choose to defend it ourselves.
14. Disputes, if you live in the United States
This section applies only if you live in the United States. It does not apply to anyone who lives in the EU or the EEA.
Read this section with care. It changes how a dispute between you and us is settled.
Talk to us first. Before either of us starts an arbitration or a court case, the one with the complaint writes to the other. You write to the support address, with “Dispute” as the subject, your name, the e-mail address on your account, what the dispute is about and what you want done. We write to the e-mail address on your account. Each notice is for one person only. We both then have 60 days to settle it, and any time limit for bringing the claim is paused for those 60 days.
Arbitration. If it is not settled, you and we agree that every dispute or claim arising from or related to these Terms or Moments, including one that arose before you agreed to these Terms, is decided by binding arbitration between you and us alone, and not in court. The US Federal Arbitration Act governs this section.
Three kinds of claim stay out of arbitration: a claim either of us brings in a small claims court, for as long as it stays there and is for one person only; a claim to stop someone infringing or misusing copyright, trademarks or other intellectual property; and a claim that the law does not allow to be sent to arbitration.
No class actions and no jury. You and we each give up the right to a trial by jury, and the right to bring or join a class action, a collective or representative action, or a class arbitration. Each of us may bring a claim only for ourselves. The arbitrator may not combine one person’s claims with another’s, and may give relief only to the person bringing the claim and only as far as that person’s claim needs.
If the law does not allow this waiver for a particular claim or remedy, that claim or remedy, and only that one, is decided in court after the arbitration of everything else has finished.
How it runs. The American Arbitration Association (the AAA, adr.org) runs the arbitration under its Consumer Arbitration Rules, with one arbitrator. If the AAA is unable to run it, you and we choose another provider together, or a court appoints one. The arbitrator decides everything about the dispute, including whether a claim belongs in arbitration, except that only a court decides whether the waiver of class actions and the paragraph on many similar claims are enforceable. The arbitrator follows these Terms and can give you, as one person, whatever a court could. The decision is in writing, it is final, and a court can enforce it.
A hearing is held by video or telephone, or in the county where you live. If your claim is for 10,000 US dollars or less, you can choose to have it decided on documents alone.
What it costs. The AAA’s rules set the fees. If your claim is for 10,000 US dollars or less, we pay back your filing fee, unless the arbitrator finds the claim was frivolous or brought for an improper purpose. Each of us pays for our own lawyers, unless the law or the arbitrator’s decision says otherwise.
Many similar claims. If 25 or more similar claims are brought against us by the same lawyers or by lawyers working together, the AAA’s Mass Arbitration Supplementary Rules apply to them. Any time limit for a claim in that set is paused from the day it is filed until its turn comes. If a court decides this paragraph is unenforceable for a claim, that claim goes to court and not to arbitration.
Opting out. You can opt out of arbitration. Write to the support address, from the e-mail address on your account, within 30 days of the day you first agreed to Terms that contain this section, with “Arbitration opt-out” as the subject, your name, and a sentence saying that you opt out. Disputes between you and us are then settled in court, under section 16. Opting out changes nothing else in these Terms, and we will not treat you differently for it.
Changes to this section. If we change this section, we tell you in the app at least 30 days before the change applies. You can reject the change by writing to the same address within those 30 days. The earlier version of this section then stays in force between you and us.
This section stays in force after your account ends.
15. If you live in the EU or the EEA
This section applies only if you live in the European Union or the European Economic Area and use Moments as a consumer. Where it differs from another section, this one applies.
Your law and your courts. Section 14 does not apply to you: no arbitration, no waiver of class or collective actions, and no waiver of any court. The law of the country where you live governs these Terms. You can bring a claim in the courts of that country, and we can bring a claim against you only there. The one-year limit in section 16 does not apply to you.
Your legal rights. Nothing in these Terms takes away a right that the law of your country gives you as a consumer and does not let you give up. You have the legal guarantee that EU law gives for a digital service, whatever section 11 says. You can withdraw from this agreement within 14 days of making your account, and you can end it at any time after that, without giving a reason, by deleting your account or by writing to the support address.
Our liability. Sections 12 and 13 do not apply to you. In their place: we are liable without limit for intent and for gross negligence, for death and for injury to body or health, under product liability law, and wherever else the law does not allow liability to be limited. For slight negligence, we are liable only when we breach a duty that is essential to this agreement, one you may rely on us to keep, and then only for the loss that was foreseeable and typical for an agreement of this kind. You are liable to us as the law provides.
Changes. We tell you in the app at least 30 days before a change to these Terms applies, and we say what changes and why. If you do not agree, you can delete your account before then. Where the law requires your agreement to a change, we ask for it. If we change Moments itself in a way that makes it worse for you in more than a small way, we tell you beforehand, and you can end this agreement by deleting your account.
The Digital Services Act. Moments stores what you send and delivers it to the people you chose. Nothing is shown to the public. Section 8 describes how we moderate: the rules, the tools, the part a person plays, and the appeal.
Anyone, with or without an account, can tell us about something they believe is illegal: by Report in the app, or by writing to the support address. A notice by e-mail says why you believe it is illegal, where it is (the Thread or Circle, who sent it, and when), your name and e-mail address, and that you believe in good faith that what you say is accurate and complete. We confirm that we received it, we decide with care and without delay, and we tell you when it has been reviewed.
If we suspend your account, we tell you why and how to appeal. If we remove something you sent, or remove you from a Circle, you can ask us at the support address for our reasons: what we did, the facts, the rule or the law behind it, and whether any step was automatic. You can appeal within 6 months, as section 8 describes, and you can always go to court.
The support address is our point of contact for you and for the authorities. Write in English.
16. Law and courts
Section 15 sets the law and the courts for people who live in the EU or the EEA.
For everyone else, the law of the place where we are established governs these Terms and any dispute arising from or related to them or to Moments, leaving aside its rules on which country’s law applies. Any dispute that is not in arbitration or in a small claims court under section 14 is decided only by the courts of that place, and you and we accept their jurisdiction.
If you are a consumer and the law where you live gives you rights that an agreement may not take away, including the right to bring a claim in your own courts, you keep them.
Where the law allows, a claim arising from or related to these Terms or Moments must be started within one year of the day it could first have been brought. After that it is barred.
17. Changes to these Terms
When these Terms change, the date at the top of this page changes with them, and we tell you in the app before the change takes effect. If a change is needed sooner because of the law or to stop harm, we tell you as soon as we are able to.
If you keep using Moments after a change takes effect, you accept it. If you do not accept it, delete your account before then.
18. The rest
These Terms are the whole agreement between you and us about Moments, and they replace any earlier one.
If a court finds that part of these Terms is not enforceable, that part is changed as little as is needed to make it enforceable, or left out if that is not possible, and the rest stays in force. Section 14 has its own rule for the waiver of class actions.
If we do not enforce part of these Terms at some time, we have not given it up.
You may not transfer this agreement to anyone else. We may transfer it to a company that takes over Moments, and that company must keep to it, section 5 included. We tell you in the app before that happens, and you can delete your account first.
These Terms give rights to you and to us, and to nobody else.
We are not responsible for a delay or a failure caused by something outside our reasonable control.
We send notices to you in the app or to the e-mail address on your account. You send notices to us at the support address.
These Terms are written in English. If they are translated and the two differ, the English text applies, as far as the law where you live allows.
